Autorisation d’urbanisme délivrée par la mairie de votre commune, le permis de construire concerne toutes les nouvelles constructions, y compris celles qui ne disposent pas de fondations, de plus de 20 m2. Permis de construire pour une maison individuelle : les étapes

Un permis de construire est nécessaire lors de la construction d’une maison individuelle à partir de 20 m2 et doit être assorti de l’accompagnement d’un architecte dès que la superficie de votre future habitation dépasse les 150 m2.

Il est désormais possible d’effectuer sa demande directement en ligne auprès du Ministère chargé de l’urbanisme. De plus, l’article 62 de la loi n° 2018-1021 du 23 novembre 2018 portant sur l’évolution du logement, de l’aménagement et du numérique (loi ELAN) prévoit que toutes les communes de plus de 3 500 habitants devront avoir des procédures dématérialisées afin de recevoir et d’instruire les demandes d’autorisation d’urbanisme et certificat d’urbanisme au 1er janvier 2022.

Délai d’instruction, décisions…

Comptez environ deux mois en tant que délai d’instruction pour une maison individuelle ainsi que ses annexes et un mois supplémentaire pour d’autres projets.

Votre permis de construire vous sera accordé si les travaux que vous envisagez sont conformes aux règles « d’utilisation des sols, d’implantation, de destination, de nature, d’architecture, de dimensions, d’assainissement des constructions et d’aménagement de leurs abords ».

Si un certificat d’urbanisme a été délivré et si votre permis est déposé sous 18 mois à compter de la délivrance de ce certificat, les règles d’urbanisme, de taxes et de participations s’appliquent telles qu’elles existaient à la date du certificat.

Quid du permis de construire dans un lotissement ?

Durant les cinq années suivant l’autorisation de lotir un terrain, la mairie sur laquelle se situent les terrains applique les mêmes règles d’urbanisme. Lorsque le lotissement a fait l’objet d’une déclaration préalable de travaux, ce délai de cinq années débute à la date de la non-opposition.

Et dans tous les cas, un permis de construire est associé à une durée de validité de trois ans. Il peut donc être périmé si les travaux n’ont pas été commencés au bout de ce délai ou si, après ce délai, vous les interrompez pendant plus d’un an.

À noter : le délai de trois ans du permis de construire peut être prolongé deux fois pour un an. La demande doit être effectuée deux mois au moins avant l’expiration du permis, et ce, sur papier libre, en deux exemplaires et par lettre recommandée. La mairie dispose de deux mois pour revenir vers vous. L’absence de réponse fait office d’acceptation.
